It is best to disclose it as early as possible but it must be disclosed in the contract, lease, or in another written document given to the other principal. As part of the Seller Disclosures referenced in Section 7 of the REPC, Seller shall provide to Buyer a copy of the underlying mortgage, the note secured. The purchase offer should include a deadline for the seller to deliver disclosures and the number of days the buyer has to review them.
